Divorce

No one walks down the aisle thinking they will be sitting in a conference room with a stranger one day trying to figure out who takes the living room furniture and who is going to pay off the Lowe’s credit card. So what is ‘divorce’ ?

North Carolina has only one divorce available and that’s an “Absolute Divorce.” While there are other ways to qualify, the main way is that you must be separated from your spouse a year and day. Said another way, if you separate June 30th, you cannot file for divorce before July 1st of the following year. As long as one spouse has the desire to be separated during that entire year (it does not have to be mutual), that’s about it.

Divorce itself is not all that complicated. What makes it tricky is all the other ‘stuff’ that comes with being married. Intertwined finances, where the kids will stay, and who is going to pay the mortgage are all common problems couples face as they walk down the road of divorce. These are all issues that can be dealt with during your year of separation.

No one plans to find themselves needing a family law attorney. Sometimes, you just need to know what the road map looks like even if you decide to go another route. A consultation to understand the issues you may be facing and how to deal with them can bring a sense of peace during a rather chaotic time of your life. If you are wondering what this looks like for your marriage, you are ready to file and need help wrapping things up, or maybe you are somewhere in-between, Locker Law is ready to talk it through with you and develop a plan that best fits your situation.
